These Terms govern every booking made through Book Ubud. They are entered into under the laws of the Republic of Indonesia, including Undang-Undang No. 11 Tahun 2008 jo. No. 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik (UU ITE) and Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). By confirming a booking and paying a deposit, you agree to be bound by them.
1. About us
Book Ubud is a direct-booking platform for a collection of private pool villas in greater Ubud (Ubud, Gianyar, Tegalalang), Bali. The business is operated by I Nyoman Suardika, an Indonesian individual entrepreneur licensed as a Pondok Wisata small-scale accommodation provider under Peraturan Daerah Provinsi Bali:
- NIB (Nomor Induk Berusaha): 1602260015674
- KBLI 55193: Penyediaan Akomodasi Jangka Pendek Lainnya (Other Short-Term Accommodation)
- Licensed as Pondok Wisata by the Government of Gianyar Regency under Bali Provincial Regulation
Our activities comply with UU No. 10 Tahun 2009 tentang Kepariwisataan (Tourism Law) and applicable Gianyar Regency and Bali Provincial tourism regulations. In these Terms, "we", "us" and "our" refer to Book Ubud; "you" refers to the guest making the booking.
2. Booking and contract formation
Bookings are formed as an electronic contract (kontrak elektronik) under UU ITE Pasal 18 and PP No. 80 Tahun 2019 tentang Perdagangan Melalui Sistem Elektronik (PMSE). The flow is:
- You send an inquiry on WhatsApp with your dates, the villa you are interested in, and the number of guests.
- We reply with a quote in Indonesian Rupiah (IDR) that includes the nightly rate, applicable taxes (PB1 10%), cleaning fee, and total.
- You pay a deposit (typically 30% of the total, or 50% for stays within 14 days of arrival) using one of the methods in Section 3.
- We send a written booking confirmation by WhatsApp once the deposit clears. This confirmation, together with these Terms, forms the full electronic contract between us.
The contract is formed when the deposit is received and we issue the written confirmation. Until that point, dates are not held and remain available for other guests. The WhatsApp message history and our written confirmation serve as alat bukti elektronik yang sah (valid electronic evidence) under UU ITE Pasal 5.
3. Prices, taxes and payment terms
- All prices are quoted in Indonesian Rupiah (IDR) as required by Undang-Undang No. 7 Tahun 2011 tentang Mata Uang. USD, EUR, GBP, AUD and SGD equivalents shown on the website are for reference only; the IDR amount is the legally binding price.
- Prices on the website and in your quote are inclusive of 10% PB1 (Pajak Hotel & Restoran), the local accommodation tax levied by the Government of Gianyar Regency under applicable Peraturan Daerah. Where any service is shown as "+10%" or "+tax", that surcharge is PB1.
- Pondok Wisata bookings are generally outside the scope of PPN (VAT) 11%. If a particular service attracts PPN, this will be disclosed in your quote before payment.
- Deposit: secures the booking. Non-refundable except as set out in our Cancellation Policy.
- Balance: due on arrival, before key handover.
- Accepted methods:
- Bank transfer to BNI (Bank Negara Indonesia): IDR
- Wise (formerly TransferWise): IDR, USD, EUR, GBP, AUD, SGD
- Cash on arrival in IDR (preferred) or USD (balance only). Per UU No. 7 Tahun 2011, the legally binding amount is the IDR equivalent at the rate stated in your written confirmation.
- All bank or transfer fees are payable by the sender unless we agree otherwise in writing.
4. Bali Tourism Levy (Pungutan Wisatawan Mancanegara)
International visitors entering Bali on or after 14 February 2024 are required to pay the Pungutan Wisatawan Mancanegara (PWA / Bali Tourism Levy) of IDR 150,000 per person, in accordance with Peraturan Daerah Provinsi Bali No. 6 Tahun 2023.
This levy is paid directly by you to the Bali Provincial Government, either online via the official LoveBali portal before travel, or on arrival at Ngurah Rai International Airport. We do not collect, handle, or remit the Bali Tourism Levy on your behalf; it is your responsibility as a traveler. We mention it here so you can plan and budget for it.
5. Check-in / Check-out
- Standard check-in: 14:00 local time (WITA).
- Standard check-out: 11:00 local time (WITA).
- Early check-in and late check-out are offered free of charge subject to availability. Please request at least 24 hours in advance.
- Each villa has its own check-in PIC whose contact details are included in the pre-arrival message. Per-villa specifics (gate codes, parking, etc.) are listed on each villa's page.
- For foreign guests, we may be required to collect passport and visa details for reporting to local banjar administration and to Imigrasi where applicable.
6. House rules
- No parties or events without the owner's prior written approval. Quiet hours apply from 22:00 to 07:00.
- No smoking indoors. Designated outdoor areas only.
- Cats welcome on prior notice. Some villas have resident cats; please let us know about allergies. Dogs are reviewed case by case.
- Maximum occupancy is strictly enforced and is listed on each villa page. Exceeding it without our written approval may result in additional fees or termination of the booking without refund.
- Illegal activities are strictly prohibited, including but not limited to the use, possession or sale of narcotics (subject to severe penalties under UU No. 35 Tahun 2009 tentang Narkotika) and any conduct contrary to Indonesian law. We are obliged to cooperate with Indonesian law enforcement.
7. Cultural and religious respect (Adat & agama)
Bali is predominantly Hindu, and Balinese culture is woven into daily life. We ask all guests to respect local adat (custom) and ongoing religious ceremonies. In particular:
- Dress modestly when visiting temples (pura) and follow any sarong / sash requirements. Our PIC is happy to advise.
- Do not step on or disturb the small daily offerings (canang sari) placed on the ground throughout Bali.
- Nyepi (Hari Raya Nyepi / Balinese Day of Silence), normally falling in March, observes 24 hours of complete silence across Bali. Movement outside, lights, fires, and noise are restricted island-wide; the airport closes; non-essential services (including pool maintenance, outside-the-villa staff, and food delivery) are suspended. Guests staying through Nyepi agree to remain on the villa premises and observe local rules for the full 24-hour period. We pre-stock essentials where possible.
8. Guest responsibilities
- Treat the property and its contents with care. Report any damage or malfunction promptly so we can fix it.
- A refundable security deposit may be requested for groups of 6 or more guests or for stays longer than 14 nights. It is returned within 7 business days after check-out, less any documented damages.
- Lock doors and windows when leaving the villa.
- Supervise children and non-swimmers in and around the pool.
- Carry valid travel insurance and observe Indonesian road rules if renting a scooter; helmets and a valid international driving permit are required by law.
9. Owner responsibilities
Consistent with our duties as an operator under UU No. 10 Tahun 2009 (Tourism Law) and UU No. 8 Tahun 1999 (UUPK), we commit to:
- Deliver the villa in the condition advertised, professionally cleaned, with all advertised amenities in working order.
- Disclose pricing, taxes (PB1), and material conditions truthfully before you pay (UUPK Pasal 4: right to clear information).
- Provide a dedicated PIC (person in charge) available 24/7 on WhatsApp during your stay for any issue.
- If any major amenity (pool, air conditioning, WiFi) is not working, we will fix it within 24 hours or offer a fair partial refund.
- Carry standard property and public liability insurance on every villa.
10. Force majeure
Neither party is liable for failure to perform when prevented by events outside reasonable control (keadaan memaksa), including natural disasters (earthquake, tsunami, volcanic eruption, flood, landslide), government restrictions, civil unrest, pandemic-related travel bans, large-scale airport closures (e.g. Ngurah Rai / Lombok closure due to volcanic ash), or mandatory religious observances such as Nyepi.
In such cases we will offer, at your choice, a free reschedule for up to 12 months or a full refund of any amounts paid, less any third-party transfer fees we have already incurred.
11. Liability
To the maximum extent permitted by Indonesian law, we are not liable for personal injury, illness, loss, or damage caused by the negligence, recklessness, or wilful conduct of guests or their visitors, including but not limited to misuse of the pool, scooter accidents, or activities arranged with third parties outside the villa.
Nothing in these Terms limits any right you have as a consumer under UU No. 8 Tahun 1999 (UUPK) or any other mandatory provision of Indonesian law that cannot be excluded by contract.
We strongly recommend you take out comprehensive travel insurance covering medical care, trip cancellation, and personal property before traveling to Indonesia.
12. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising out of or in connection with a booking will first be addressed by good-faith discussion on WhatsApp.
If the dispute cannot be resolved that way within 30 days, consumer matters will be referred to the Badan Penyelesaian Sengketa Konsumen (BPSK) Gianyar in accordance with UU No. 8 Tahun 1999 tentang Perlindungan Konsumen. Commercial disputes may, by mutual agreement, be referred to the Badan Arbitrase Nasional Indonesia (BANI). Otherwise, both parties submit to the exclusive jurisdiction of the Pengadilan Negeri Gianyar (Gianyar District Court), Bali.
13. Changes to these Terms
We may update these Terms from time to time, for example, to reflect changes in payment partners, regulation (such as updates to UU PDP, UU ITE, or PB1 rates), or our operations. The current version is always published at /terms/. Bookings already confirmed are governed by the version in force at the time of the deposit.
